As others have said contacting the AMA is your best bet click here.....

Also, have an attorney file a wrongful death civil suit. Even though the driver was not cited it does not preclude his family from doing this. Remember OJ was acquitted in criminal court but was found responsible in civil court. This may also get the prosecutors/police to rethink the case.

Lawsuits for dummies: I speak from experience and my wife is a paralegal

The lawsuit is standard stuff and is considered prudent not unethical. I was sued eventhough I wasn't cited until latter for an accident where I turned in front of a guy. The guy was not killed but suffered injuries cause he was not wearing a seat belt. In that case the suit was not filed until years latter because they had to determine what injuries were permanment and how much it cost for pain and suffering etc. My case settled for less than my liability most of it in legal fees. But it taught me that having liability insurance in excess of $100,000 is prudent cause legal fees can eat it up. .. In this case, the guy is dead and your argument on the time is irrelevant. They can file this a year or two. The first step is the lawyer not hiring your own experts.

I disagree this is pratical stuff. Hopefully this generates constructive help for everyone. It's a good topic hopefully people can contribute what they know. I speak from having caused an accident back in my young and irresponsible days, that I wish someone would of told me a couple of thing like:

1. $100,000 liability insurance is not enough.

2. Even though you only have a cetain amount of insurance they can garnish your wages at 10% until your judgement is paid off.

3. While turing left on on a green light be more cautious.

4. You can be sued anytime after the accident up to a legal limit (3 years i think). Even though the other person was not wearing a seat belt and cited I was still at fault and liable..... Most people think its like football i.e. offsetting penalities...

Hey I am only sharing my experience and my wifes. Take or leave it. But to assume that the state patrol did everthing correctly like BMW is folly. According to that logic the South Dakota state patrol was correct to let Jaklow drive recklessly on numerous occasions. Lawyers and paralegals have to look at things from a pessimistic Murphy's law perspective. You have to go in assuming things weren't done right....

Lawyers a necessary and valuable part of our great legal system.

The world would be a better place without lawyers. .Really ???? I thank god I live in country where there is a legal system that disputes can be settled peacefully in court, as opposed to having a socialist burearcrat decide or a monarch decide or the force of gun decide who is right and who is wrong.

At the risk at being shouted down again by guys who have no experience in this type of situation and who love to play armchair quaterback (lawyer, cop, accident investigator) I am going to say this again.

Contact a personal injury attorney like this outfit which advertises on TV on Speed Channel

Motorcycle Attorneys


Personal Injury Attorneys usually work on a contingent basis so there is no cost to the family. They can also work the criminal side i.e. get the district attorney's office to consider charges.

The AMA usually doesn't do much good after the fact. They specialize in preemptive legislation etc.

You criticize me for sharing my experience and knowledge and then you post this absolutely no help post. Leve it to the professionals .

You remind me of those grumpy old men at the diner back home who complain a lot but never do anything about it.

There are good reasons why we have a legal system which has two components a civil side and a criminal side. It ain't perfect but it's the best system on the planet. Senator John Edwards made a fortune helping people who were screwed by others. So sometimes it works.

For someone that claims to be a lawyer you seem to be making some contradictory statements.

Funny I thought it was you that had the site "Porn for Polygamist pedophiles "It's a slippery slope what you are playing keep playing it and you will see the long arm of the law at your door. Note the self-proclaimed "Esquire" agrees with my advice now.....

Anyone who is into child porn needs to be used for target practice. You are going to new depths seruzawa to suggest that I have anything to do with it....My wife says its probably you that is into it.

Those who can do Those who can't teach. About the parallelex affect I was being sarcastic the mentioned professor er instructor rather of physics supported a dubious argument (parallex) put forth by the MO editor in an earlier agrument.

The Physics department is the minor league of the Engineering College at any university.

By the way Road Racing World debukes the 205 mph rider

RRW didn't give any stock to the parrallex effect. They like me knew the guy wasn't going 205 and though it was a ithchy finger by the trooper which caused the error. RRW is a great magazine which has great technical writeups cause they have a P.E. professional engineer that writes about tech issues. Better than the guy who writes the psuedo science babble in Cycle World....
