I am investigating an accident involving a 2002 Suzutki 1200 Bandit that was rearended at over 80 mph. The mc's rear wheel was crushed and the bike is stuck in gear. I need to know what gear it is stuck in. I removed the chain and was able to find neutral then shift up four times. I need to know if the fact that I can not shift to 5th means that it is stuck in 5th or does it mean that it is in 4th.

Can anyone help?

If it is stuck in gear then you wouldn't be able to shift it at all. Sorry but your question makes no sense.

Yeah right....

Rear-ended at 80. I'm thinking $1 to $1.5 million for the opening settlement bid.
...but I was honking the horn, and he wouldn't get out of the way...wait a second, I mean I didn't see him. Yeah, that's the ticket.

Might as well have a big bull's eye painted on your back anymore.

As for being stuck in gear, that's fifth, I think...
